These Terms & Conditions (“Terms”) govern your use of the website samuraiijapan.com (“Website”), operated by Samurai Japan K.K., a company registered in Japan as a Travel Service Arrangement Business (旅行サービス手配業), Governor of Chiba Prefecture Registration No. 220, with its registered office at Fujigaya 544-20, Kashiwa-shi, Chiba 277-0931, Japan (“Samurai Japan”, “we”, “us” or “our”).

These Terms govern use of the Website only. They do not constitute the booking conditions for any travel programme. Any travel programme arranged by Samurai Japan is subject to the separate quotation, booking conditions, confirmation and other contractual documents issued for that programme.
Scope of our registration. Samurai Japan is registered as a Travel Service Arrangement Business (旅行サービス手配業). That registration applies to travel-service-arrangement activities within the scope permitted by Japanese law, including arrangements made for travel businesses. Where a proposed service or transaction requires a different registration, licence, intermediary or contractual structure, Samurai Japan will not provide that service unless the applicable legal requirements are satisfied.
Samurai Japan provides destination-management and travel-service-arrangement services in Japan. Depending on the programme, we may arrange or coordinate services including:
Where appropriate, services are provided by independent hotels, ryokan, transport operators, guides, venues and other suppliers. Our role in relation to each service will depend on the applicable contract and quotation.
Nothing on this Website should be interpreted as meaning that Samurai Japan itself operates every hotel, vehicle, restaurant, attraction, guide service or other service described on the Website. This distinction is important because Japanese law distinguishes between different forms of travel business and travel-service arrangement activity.
Information on this Website is provided for general information and programme-planning purposes. Photographs, itineraries, destinations, vehicle models, experiences, hotels, restaurants, durations and other examples may be illustrative. Their appearance on the Website does not guarantee:
The actual services applicable to your programme are those confirmed in writing by Samurai Japan.
Submitting an enquiry through the Website does not create a booking or contractual obligation. The Website enquiry form is a means of communicating your requirements to us.
A programme becomes contractually binding only when Samurai Japan has accepted the booking in accordance with the applicable booking conditions and issued the required confirmation or other contractual documentation.
Our advertised proposal response time of 48 working hours is a service target and not a contractual guarantee. Response times may be affected by:

Where a supplier requires an earlier deposit or payment deadline, that deadline may apply even if the traveller’s overall payment deadline is later.
The legal relationship for a confirmed programme will be governed by the documents issued for that programme. Depending on the nature of the transaction, these may include:
Where a specific programme document expressly conflicts with these Website Terms, the programme-specific contractual document will prevail for that programme. Where mandatory Japanese law requires a particular form, disclosure, notice or contractual term, that mandatory requirement will prevail.

We select and coordinate suppliers with reasonable care. Unless expressly stated otherwise in the applicable programme contract, Samurai Japan does not itself operate the underlying hotel, transport, restaurant, venue, attraction or other supplier service.
Supplier-specific conditions may apply. Where a supplier’s terms are incorporated into your programme, those terms will be communicated or made available as required.
Where private or chartered transportation is arranged, Samurai Japan uses appropriately licensed Japanese passenger-transport operators where required.
Vehicle photographs and descriptions on the Website are illustrative. The confirmed vehicle may differ in:

Transport routes and timings may reasonably change because of traffic, road restrictions, weather, public events, road closures, safety requirements, vehicle restrictions, or circumstances outside the operator’s reasonable control.
Travellers are responsible for providing accurate and complete information reasonably required to arrange their programme. This includes, where applicable:
You must promptly tell us if information changes. Samurai Japan cannot be responsible for additional costs or service failures caused by inaccurate, incomplete or late information supplied by the traveller or booking agency.
Travellers are responsible for ensuring that they possess the documents required for their journey, including valid passports, visas, immigration permissions, transit permissions, vaccination or health documentation where legally required, and other mandatory travel documents.
Where we provide information about entry requirements, that information is provided for assistance only and should be independently verified with the relevant Japanese authorities, embassy or consulate. Samurai Japan does not guarantee admission to Japan or any other country.
Unless expressly included in a programme, travel insurance is not provided by Samurai Japan. We strongly recommend appropriate travel insurance covering, as relevant, medical expenses, emergency evacuation, cancellation, interruption, baggage, personal liability, missed connections and other foreseeable travel risks.
A traveller or booking agency may request changes to a confirmed programme. We will use reasonable efforts to accommodate them. However, changes may result in:
The applicable charges will be communicated before confirmation of the change where reasonably practicable.
Cancellation terms are programme-specific. The applicable cancellation deadlines and charges will be stated in the quotation, booking conditions or confirmation. Cancellation charges may include amounts payable to third-party suppliers and Samurai Japan’s applicable handling or administration charges.
Some services may be non-refundable, partially refundable, subject to supplier-specific deadlines, or subject to 100% cancellation charges after a particular date. Where a supplier imposes a non-refundable charge, Samurai Japan may pass that charge to the traveller to the extent permitted by applicable law and the agreed booking conditions.
If a traveller fails to use a confirmed service — including because of late arrival, missed transportation, failure to attend, failure to notify us, inability to locate the meeting point, or other traveller-related circumstances — the service may be treated as a no-show.
Refunds will depend on the applicable supplier and programme cancellation conditions. Additional costs incurred in arranging replacement services may be charged where permitted by the applicable contract.
Where reasonably necessary, Samurai Japan may substitute a supplier, vehicle, accommodation, guide, venue or experience because of unavailability, closure, safety, weather, operational requirements, supplier failure, government restrictions, or other circumstances outside our reasonable control.
Where substitution materially affects the programme, we will use reasonable efforts to provide a reasonably comparable alternative. Where the replacement is materially inferior and applicable law or the programme contract requires an adjustment, the appropriate adjustment will be made.
Samurai Japan will not be responsible for failure or delay caused by circumstances beyond our reasonable control. Such circumstances may include:
Where such circumstances occur, we will take reasonable steps to assist affected travellers and minimise disruption. Nothing in these Terms excludes liability that cannot lawfully be excluded.
We will use reasonable efforts to accommodate disclosed accessibility, dietary and other special requirements. Such requirements should be communicated before booking wherever possible. We cannot guarantee that every Japanese supplier or facility will be able to accommodate every requirement.
Where information concerning health, disability, allergies or other sensitive matters is necessary for safe programme delivery, we may request that information through an appropriate channel and use it only for the relevant operational purpose, subject to applicable privacy law.
For school, university and youth programmes:
Separate institutional terms may be issued for educational programmes.
Meetings, incentives, conferences, exhibitions and corporate programmes may be subject to separate programme-specific conditions covering minimum group sizes, deposits, venue cancellation, production costs, supplier deadlines, room blocks, event production, transport, staffing, security, overtime, last-minute amendments and force majeure. Those conditions will prevail where expressly agreed.
To the maximum extent permitted by applicable Japanese law, Samurai Japan will not be responsible for loss arising solely from reliance on general information on this Website, temporary Website unavailability, third-party websites, information supplied incorrectly by a traveller or booking agency, or events outside our reasonable control.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited. In particular, nothing excludes liability arising from fraud, wilful misconduct, or death or personal injury where such exclusion would be unlawful.
For confirmed programmes, liability is governed primarily by the applicable programme contract and mandatory Japanese law.
We want problems to be reported as soon as reasonably possible so that we can attempt to resolve them during the programme. A complaint should normally be raised with the Samurai Japan contact provided for the programme, with the relevant supplier where appropriate, and with Samurai Japan as soon as reasonably practicable. Nothing in this section limits any complaint, consultation or dispute-resolution right that cannot lawfully be excluded.
Failure to report a problem promptly may make it more difficult to investigate or remedy the issue, but does not waive any mandatory legal right.
The Website and its contents, including text, design, graphics, branding and original materials, belong to Samurai Japan K.K. or are used with permission. You may not reproduce, commercially exploit, modify, distribute or republish Website content without written permission, except where permitted by law.
The Website may contain links to third-party services including WhatsApp. We do not control those services and are not responsible for their content, availability, security or privacy practices. Your use of those services is governed by their respective terms and policies.
Personal information is handled in accordance with our Privacy Policy. The Privacy Policy forms part of our Website information framework but does not itself constitute the booking contract.
These Terms are governed by the laws of Japan. Subject to any mandatory jurisdiction or consumer-protection rights that cannot lawfully be excluded, the Chiba District Court shall have exclusive jurisdiction as the court of first instance for disputes arising from these Website Terms.
For a confirmed travel programme, the jurisdiction and dispute-resolution provisions in the applicable programme contract will apply where expressly stated and legally effective.
We may update these Website Terms when necessary. The version published on this Website at the relevant time will apply to Website use from that point onward. Changes will not retrospectively alter a confirmed programme contract unless legally permitted and expressly agreed.
